1. Purpose

Luxury Vacations specializes in the management, promotion, and administration of luxury properties, private residence clubs, and timeshares in Mexico and the Caribbean. These Terms and Conditions govern the use of our website and the services we offer.

2. Website Use

Users agree to use this website lawfully, avoiding any activities that may harm the image, interests, or rights of Luxury Vacations or third parties. It is prohibited to use the site to distribute illegal, defamatory, offensive, or infringing material that violates intellectual property rights. The platform may not be used for fraud, impersonation, or any unlawful misuse.

3. Intellectual Property

All content on this site, including but not limited to text, images, logos, trademarks, designs, and software, is the exclusive property of Luxury Vacations or is used under the corresponding licenses. Any reproduction, distribution, or modification without express written authorization is strictly prohibited.

4. Reservations, Payments, and Fees

Payment for the selected room or property listing fee is one-time only and must be made at the time of confirming the listing. Once the listing fee has been paid, no refunds will be issued under any circumstances.

When the property is rented, the commission percentage charged by Luxury Vacations will depend on the platform through which the rental was completed, and may range from 10% to 30%. Commissions may vary depending on the season, the city, and the property.

Luxury Vacations does not guarantee a specific time by which a property will be rented. The actual time to secure a rental may vary significantly due to market demand and other factors beyond our control.

If a requested reservation from a client cannot be confirmed by the property owner within 72 hours, Luxury Vacations reserves the right to offer the rental opportunity to the next interested client. Once a requested week has been reserved, it cannot be canceled.

The commission payment is due within 72 hours after the renter has checked in to the listed property. All commission payments are to be made via bank transfer. The time required for the transfer to be completed depends on the country and the bank involved.

5. Limitation of Liability

Luxury Vacations shall not be liable for any direct or indirect damages resulting from the use of the website, from errors in information provided by third parties, or from the temporary unavailability of the platform.

6. Third-Party Links

Our website may contain links to external pages. Luxury Vacations has no control over the content or policies of such sites and assumes no responsibility for their use.

7. Force Majeure

Luxury Vacations shall not be held responsible for delays or cancellations of reservations due to events beyond our control, including but not limited to natural disasters, pandemics, wars, acts of terrorism, governmental actions, or other catastrophic events. In such cases, while the reservation may be canceled, no refunds will be issued unless required by law.

8. Modifications

Luxury Vacations reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page along with the updated date.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the United Mexican States. Any disputes shall be submitted exclusively to the competent courts located in Cancún, Quintana Roo, Mexico, and conducted in the Spanish language.

For the avoidance of doubt, all parties acknowledge that the time frame within which a property is rented depends on numerous factors beyond the control of Luxury Vacations, including but not limited to market demand, seasonal trends, competitive listings, and broader economic conditions. No representation is made regarding the exact date or period when the rental will occur.

The Owner understands and accepts that the fees, commissions, and charges applicable to each rental transaction may vary depending on multiple factors, including but not limited to the location of the property, the time of year, the specific platform used for booking, and any promotional agreements in place at the time of the rental.

By using our services, the Owner grants Luxury Vacations the exclusive right to market, promote, and list the property through its network of platforms, partner agencies, and other marketing channels deemed appropriate by Luxury Vacations. This exclusivity remains valid for the duration of the active listing period as agreed upon.

Luxury Vacations may update its marketing strategies, promotional campaigns, and listing descriptions at any time, without the obligation to obtain prior approval from the Owner, provided that the changes are in the interest of maximizing booking potential and revenue generation.

The Owner acknowledges that while Luxury Vacations takes reasonable measures to attract potential renters and promote the property, the actual performance of the listing will depend on market forces and consumer behavior, which are inherently unpredictable.

The Owner and Luxury Vacations agree that all official communications related to these Terms and Conditions shall be conducted via email, and such communications will be deemed received by the recipient within 24 hours of transmission unless an error notice is received by the sender.

Both parties agree to act in good faith in all dealings under these Terms and Conditions, refraining from any actions that may harm the commercial interests, reputation, or contractual rights of the other party.

These Terms and Conditions constitute the entire agreement between the parties and supersede any prior understandings, whether written or oral, relating to the subject matter herein.
